Welcome to fitconnect. By accessing or using our platform, you agree to be bound by these Terms of Use and our Privacy Policy. If you do not agree to these terms, please do not use our services.

fitconnect is a marketplace platform that connects fitness clients with certified coaches. We facilitate connections but are not responsible for the actual coaching services provided.

2. Eligibility

To use fitconnect, you must:

• Be at least 18 years old
• Have the legal capacity to enter into binding contracts
• Provide accurate and complete registration information
• Comply with all applicable laws in Singapore

3. User Accounts

3.1 Account Creation

You may create an account as either a client or a coach. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring all information provided is accurate and up-to-date

3.2 Account Termination

We reserve the right to suspend or terminate your account if you violate these terms or engage in fraudulent, abusive, or illegal activities.

4. Coach-Specific Terms

4.1 Coach Application & Verification

To become a coach on fitconnect, you must:

• Submit a complete application with accurate information
• Provide valid fitness certifications and credentials
• Pass our verification process
• Maintain active professional certifications
• Comply with all applicable fitness industry regulations in Singapore

4.2 Coach Responsibilities

As a coach, you agree to:

• Provide accurate profile information and keep it updated
• Respond to client inquiries in a timely and professional manner
• Deliver coaching services with professional competence
• Maintain appropriate insurance coverage for your services
• Comply with all safety and health regulations
• Not misrepresent your qualifications or experience
• Respect client privacy and confidentiality

4.3 Platform Access Fees

Coaches are required to maintain an active subscription to access platform features:

• Subscription fees are non-refundable
• You may cancel your subscription at any time
• Access continues until the end of your current billing period
• Pricing may change with 30 days' notice

4.4 Direct Client Relationships

Once connected through fitconnect, all coaching services, payments, and contracts occur directly between you and the client. fitconnect is not a party to these relationships and assumes no liability for services rendered.

5. Client-Specific Terms

5.1 Client Responsibilities

As a client, you agree to:

• Provide accurate information about your fitness goals and health status
• Communicate respectfully with coaches
• Consult with medical professionals before starting any fitness program
• Not hold fitconnect liable for any injury or health issues arising from coaching services

5.2 Health and Safety Disclaimer

You acknowledge that physical fitness activities carry inherent risks. You should consult a physician before beginning any exercise program. fitconnect is not responsible for any injuries or health complications resulting from coaching services.

6. Platform Usage Rules

You agree NOT to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Upload malicious code, viruses, or harmful software
• Scrape, harvest, or collect user data without permission
• Impersonate another person or entity
• Post false, misleading, or defamatory content
• Harass, abuse, or threaten other users
• Attempt to circumvent platform security measures
• Use the platform for any illegal or unauthorized purpose
• Create multiple accounts to manipulate the platform

7. Content and Intellectual Property

7.1 Your Content

You retain ownership of content you upload (photos, bio, certificates). By posting content, you grant fitconnect a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content for platform operations.

7.2 Our Content

All fitconnect branding, logos, design, text, and software are owned by fitconnect and protected by intellectual property laws. You may not use our intellectual property without written permission.

8. Payments and Refunds

8.1 Platform Fees

Coach subscription fees are processed through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.

8.2 Refund Policy

Platform subscription fees are non-refundable. You may cancel your subscription at any time, and access will continue until the end of the current billing period.

8.3 Direct Coach Payments

Payment arrangements between clients and coaches are handled directly between parties. fitconnect does not process, hold, or refund payments for coaching services. All payment disputes must be resolved directly between client and coach.

9. Disclaimers

fitconnect is provided "as is" and "as available" without warranties of any kind. We disclaim all warranties, express or implied, including:

• Accuracy, completeness, or reliability of coach profiles
• Quality or safety of coaching services
• Uninterrupted or error-free platform operation
• Security of data transmission

We verify coach credentials to the best of our ability, but we do not guarantee the quality or outcomes of coaching services. Use of our platform is at your own risk.

10. Limitation of Liability

To the maximum extent permitted by Singapore law, fitconnect and its affiliates shall not be liable for:

• Indirect, incidental, special, or consequential damages
• Loss of profits, revenue, data, or business opportunities
• Personal injury or property damage arising from coaching services
• Disputes between clients and coaches
• Actions or omissions of coaches or clients

Our total liability for any claim shall not exceed the amount you paid to fitconnect in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless fitconnect, its affiliates, and employees from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms of Use
• Your use of the platform
• Content you post on the platform
• Your interactions with other users
• Coaching services provided or received through the platform

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of Singapore. Any disputes shall be subject to the exclusive jurisdiction of Singapore courts.

12.2 User Disputes

Disputes between clients and coaches must be resolved directly between the parties. fitconnect is not obligated to mediate or resolve such disputes.

13. Changes to Terms

We may update these Terms of Use at any time. Significant changes will be communicated via email or platform notification. Continued use of the platform after changes constitutes acceptance of the updated terms.

14. Termination

We may suspend or terminate your account immediately, without notice, for:

• Violation of these Terms of Use
• Fraudulent or illegal activity
• Harmful conduct toward other users
• Non-payment of subscription fees (for coaches)

Upon termination, your right to use the platform ceases immediately. Sections regarding liability, indemnification, and dispute resolution survive termination.
